Speed U — Terms & Conditions

PLEASE READ THESE TERMS CAREFULLY BEFORE USING SPEED U.

These Terms & Conditions ("Terms") govern your access to and use of the Speed U website (speedu.ca), the Speed U mobile application, and any related services (collectively, the "Service"), operated by Specific Physical Elements for Enhancing Development Inc. ("Speed U," "we," "us," or "our").

By creating an account or using the Service, you (or, if you are a minor, your parent or legal guardian on your behalf — see Section 2) agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.

We may change these Terms at any time. We will update the "Last revised" date above when we do. Continued use of the Service after a change is posted means you accept the revised Terms.


1. What Speed U Is

Speed U is a skill-development platform for hockey (and, in the future, other sports) players, offered through two connected surfaces:

  • The speedu.ca website — training content (skills tutorials, drills, game blends, programs), membership registration, and billing.
  • The Speed U app (app.speedu.ca and the mobile app) — users submit videos of themselves performing specific skills, which are reviewed either by the community of other users, a coach or instructor, or Speed U staff, and awarded experience points ("XP") and other in-app rewards for skills completed correctly.

The two share one account and membership system: your speedu.ca account is your app account, and paid app features are billed through your speedu.ca membership. These Terms cover both surfaces; sections about submitting videos, judging, and in-app rewards apply when you use the app, and sections about purchases and memberships apply when you buy on speedu.ca.

2. Age Requirements and Parental Consent

Speed U is used by players across a wide age range, including children under 13. When you create an account, we ask which age group the account is for, and the signup process changes based on the answer:

  • If you are 18 or older, you may create and manage your own account.
  • If you are 13 to 17, you may create your own account, but a parent or legal guardian must first read and agree to these Terms and the Privacy Policy on your behalf. You confirm this during signup by checking a box saying they have. That parent or guardian remains responsible for the account and your use of it.
  • If the player is under 13, the account must be created by their parent or legal guardian directly — not by the child. The parent/guardian provides their own name and email address (kept as our consent record, separate from whatever email the account logs in with), and consents to the child's use of the Service and to these Terms and the Privacy Policy on the child's behalf, before any personal information — including video — is collected from the child. That email address is then confirmed with a one-time code sent to it; the account can browse before that code is entered, but cannot submit any video until it is. This is how we obtain the parental consent required by applicable children's privacy laws (including COPPA in the United States). See the Privacy Policy's "Children's Privacy" section for what this means in practice.

⚠️ IF YOU ARE UNDER 18: A PARENT OR LEGAL GUARDIAN MUST READ THESE TERMS AND OUR PRIVACY POLICY BEFORE YOU USE SPEED U. If you are 13-17, checking the consent box at signup means your parent or guardian has actually read and agreed to these documents — not just that you agree yourself. If they haven't read them yet, stop and have them do that first. If the player is under 13, only a parent or guardian may create the account at all.

A coach or instructor linking a student to their roster does not replace the need for that student's own parent/guardian consent to use the Service in the first place.

We rely on the accuracy of information provided at signup. We are not able to independently verify every user's age, but we do not knowingly collect personal information from a child without the consent described above, and we will act promptly to address it if we learn that has happened without proper consent.

3. Accounts

If your use of the Service requires an account:

  • you are responsible for your account, its password, and everything that happens under it, including actions taken by anyone else who accesses it with or without your permission;
  • you agree to notify us promptly of any unauthorized use of your account or any other breach of its security, and to help us investigate and address it;
  • you agree to provide true, current, and complete information when asked, and to keep it up to date;
  • Speed U accounts are linked to a corresponding speedu.ca membership account. Deleting your Speed U app account does not cancel or affect your speedu.ca membership or billing — see Section 8 and the Privacy Policy for what account deletion does and doesn't do.

4. Intellectual Property (Ours)

Other than content submitted by users (see Section 5), all content on the Service — including text, software, code, designs, graphics, photos, sounds, music, videos, applications, interactive features, the Speed U name and logo, and the skill catalog and instructional materials — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. All trademarks, service marks, and trade names are owned, registered, and/or licensed by us. Nothing in these Terms grants you any license to that material beyond what's needed to use the Service normally (view your own progress, watch instructional videos you're entitled to see, etc.).

Company materials. We may provide you with documentation, data, or other information developed by us to assist your use of the Service. That material may not be used for any purpose other than using the Service and the features offered on it, and nothing in these Terms may be interpreted as granting you any license of intellectual property rights in it.

5. Your Videos and Other Content You Submit

When you submit a video, photo, comment, or other content to Speed U ("User Content"), the following applies.

You keep ownership. We do not claim ownership of your User Content. You retain whatever rights you already have in it.

You grant us a license to use it. By submitting User Content, you grant Speed U a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and use that content:

  • to operate the Service itself (showing your video to community judges, your coach or instructor, and to you);
  • to promote and market Speed U, including on social media, our website, advertising, and other promotional materials — for example, featuring a great trick submission in an Instagram post or a highlight reel.

This license lasts for as long as we retain the content (see the Privacy Policy's Data Retention section) and continues to apply to any copies already used for the promotional purposes above even after that, to the extent reasonably necessary (for instance, we won't scrub a social media post that already went out six months ago, but we will stop actively using new content from a deleted account going forward).

The marketing part of this license is a separate, explicit consent point, not buried boilerplate. Because Speed U's users include children and teens, the marketing/promotional use above is presented as its own clear yes/no choice — answered by the parent/guardian during signup for an account they create for a player under 13, and by everyone else in a one-time question the first time they use the app — not something you're assumed to have agreed to just because it's written here. If you (or your parent/guardian) decline this specific permission, your video is still usable to operate the Service (judging, coaching) but will not be used for marketing/promotional purposes outside the app.

Your other representations. By submitting User Content, you represent that: it's actually yours to submit (you're not uploading someone else's video or someone else's performance as your own); you have the right to grant the license above; and it doesn't violate anyone else's rights or these Terms' Acceptable Use rules (Section 7).

We can remove it. We may remove, restrict, or refuse to display any User Content at our discretion — including content that's inappropriate, offensive, violates these Terms, or that a moderator has flagged for removal (see Section 8 on account actions). Removing content that already earned XP or in-app currency also reverses that XP/currency, so a removed submission doesn't leave you with credit for something that's no longer there.

Other users' content. User Content is the responsibility of the person who submitted it, not of Speed U. We do not pre-screen every submission before it becomes visible (community judging means other users often see a video before we do), and despite our Acceptable Use rules (Section 7) and moderation, you may encounter content that is inaccurate, offensive, or otherwise objectionable. To the fullest extent permitted by law, we are not liable for any user's content or conduct. If you see content that shouldn't be on Speed U, report it using the in-app Report button (on the video or on the user's profile) or by contacting us (Section 19), and we will review and act on it, including removing it and taking the account actions described in Section 8.

6. Payment, Memberships, and Purchases

Paid Speed U features (Pro/Platinum tiers, coach seats, etc.) are billed through your speedu.ca membership, not directly through the app. When you make a purchase, you agree to provide a valid payment instrument and confirm you are permitted to use it, and you authorize us (and our designated payment processor) to charge the full amount of the transaction and to collect and store that payment instrument along with related transaction information. Pay attention to the details of the transaction — your total price may include taxes and fees, which you are responsible for. We do not store your full payment card details ourselves.

If you pay by credit or debit card, we may obtain a preapproval from the card's issuer for an amount as high as the full price; if you cancel a transaction before completion, that preapproval may result in those funds not being immediately available to you. We may cancel any transaction if we believe it violates these Terms or that doing so may prevent financial loss. To prevent financial loss to you or to us, we may contact your payment instrument's issuer, law enforcement, or affected third parties (including other users) and share details of any payments you are associated with, if we believe doing so may prevent financial loss or a violation of law.

Goods and services. We may sell goods or services, or allow third parties to sell goods or services, on the Service. We work to be as accurate as possible with all information about them, including product descriptions and images, but we do not guarantee the accuracy or reliability of any product information, and you acknowledge that you purchase such products at your own risk.

Affiliate marketing and advertising. We may engage in affiliate marketing through the Service, where we receive a commission on or a percentage of the sale of goods or services made on or through the Service. We may also accept advertising and sponsorships from commercial businesses or receive other forms of advertising compensation.

In-app currency ("Diamonds"). Diamonds are a virtual, non-transferable currency earned through in-app activity (like completing a trick or correctly judging someone else's submission). Diamonds have no cash value, cannot be exchanged for money, transferred between accounts, or redeemed outside the Speed U Shop, and may be adjusted (including reduced) if the activity that earned them is later reversed — for example, if a video that earned Diamonds is removed for violating these Terms.

Refunds. Membership refunds are governed by speedu.ca's own billing terms. Suspending or banning an account from the app (Section 8) does not, by itself, entitle you to a refund of any paid speedu.ca membership, and does not pause or cancel that membership — your subscription continues billing independently unless you cancel it directly through speedu.ca.

7. Acceptable Use

You agree not to use the Service to:

  • harass, bully, threaten, or abuse another person, or violate anyone's legal rights;
  • impersonate another person, submit someone else's video or performance as your own, or let someone else submit on your behalf without disclosing it (instructor-submitted videos are the one built-in, clearly-labeled exception to this);
  • submit the same video more than once, or resubmit old footage as a new attempt -- every submission must be a genuine, new recording of the attempt it claims to be;
  • upload content that is sexually suggestive, violent, hateful, or otherwise inappropriate for a platform used by children — including requiring reasonably modest attire in any video you submit;
  • create multiple accounts to manipulate XP, voting, rankings, or Diamonds, or share a single account between multiple people;
  • attempt to manipulate community judging through coordinated or bad-faith voting;
  • upload viruses, malware, or anything intended to damage or disrupt the Service;
  • scrape, data-mine, or use automated tools to interact with the Service outside normal use;
  • attempt to bypass, disable, or interfere with any security feature of the Service;
  • perpetrate any fraud;
  • engage in or create any unlawful gambling, sweepstakes, or pyramid scheme;
  • publish or distribute any obscene or defamatory material, or any material that incites violence, hate, or discrimination toward any group;
  • unlawfully gather information about others, including harvesting email addresses or personal information;
  • use the Service for spam of any kind, including sending mass commercial emails;
  • use the Service in any way that could damage the Service or the general business of Speed U;
  • use the Service for any unlawful purpose.

Violating this section may result in content removal, a warning, a temporary or permanent ban (Section 8), or all of the above.

8. Suspension, Banning, and Termination

We may suspend, restrict, or permanently ban a user's access to the app at our discretion, effective at any time and without notice — including for violating these Terms, submitting inappropriate content, behavior that harms other users or the community, any amount past due from you to us, a third-party complaint relating to your use of the Service, or use that impairs the operation of the Service or our (or any third party's) equipment or network. We have no responsibility to notify any third party — including any third-party providers of services or information — of any suspension, restriction, or termination of your access.

A ban affects app access only. Banning an account from the Speed U app does not cancel, pause, or refund the person's underlying speedu.ca membership. If you are banned while holding a paid membership, that membership keeps billing on its normal schedule unless separately canceled through speedu.ca; you are not entitled to a refund for the banned period solely because of the ban. We recommend canceling any active speedu.ca subscription yourself if you no longer intend to use the app.

Permanent bans block the email, not just the account. A permanent ban prevents that email address from creating a new account in the future, not just from using the existing one.

We may also suspend the Service entirely, or discontinue features, at our discretion, and we're not liable for any inconvenience that causes.

9. Community Judging and Visibility

A core part of Speed U is community judging: other users may view and vote on your pending skill or challenge submissions to help confirm you completed them correctly. This means:

  • a submitted video may be visible to other Speed U users, not only to Speed U staff or your own coach/instructor — on the judging feed while it's pending, and on your public profile page both while pending and after it's resolved (approved or rejected);
  • your username, and in some cases your avatar, are visible to other users through leaderboards, the judging feed, and public profile pages;
  • a coach or instructor you're linked to can see your progress, submissions, and (for instructors specifically) may submit a video on your behalf with your or your parent/guardian's prior consent.

Linking to a coach or instructor includes a video-use permission. When you (or your parent/guardian) link your account to a coach or instructor by redeeming their code, you check a box agreeing that this specific coach or instructor may use your videos — including on their own social media, such as a team account. This is a grant to that coach/instructor personally, is separate from the Speed U marketing consent in Section 5 (declining that one does not undo this one, and vice versa), and ends for new videos if the link is removed. Coaches and instructors are responsible for their own social media accounts and their own use of videos under this permission; links created before this permission existed (before the checkbox said so) only cover coaching use, not the coach's or instructor's social media.

10. Third-Party Services

The Service relies on third-party infrastructure to operate, including cloud video storage, our membership/authentication systems, and (for certain optional AI-powered features) a third-party AI service that analyzes uploaded footage. Details of what's shared with which providers, and why, are in the Privacy Policy. We are not responsible for the practices of independent third-party services we merely link to (for example, a third-party site referenced from a Program listing).

11. Physical Activity and Assumption of Risk

The Service shows and describes physical skills, drills, and workouts — skating, shooting, agility, strength and conditioning, and similar activities — that you perform yourself, in the real world, off the platform. We don't supervise you while you do this, don't inspect the space or equipment you use, and don't verify that any particular skill or drill is appropriate for your age, fitness level, or ability before you attempt it.

Physical activity carries an inherent risk of injury, including serious injury, even when performed correctly, and that risk increases if a skill or drill is attempted without proper supervision, in an unsuitable space, without appropriate protective equipment, or beyond what the player attempting it is physically ready for. Some skills or drills may call for specialized equipment (for example, a net, weighted equipment, or other apparatus) — using that equipment safely, including following its manufacturer's own instructions and warnings, is your responsibility, not ours.

By using the Service, you (or, for a player under 18, their parent or legal guardian on their behalf — see Section 2) acknowledge this risk and voluntarily assume it. To the fullest extent permitted by law, Speed U is not responsible or liable for any injury, death, or property damage arising from attempting a skill, drill, workout, or other physical activity shown, described, or referenced on the Service, whether or not it was performed as instructed. Nothing here waives a right that cannot be waived under applicable law.

12. No Warranties

Your use of the Service is at your sole and exclusive risk, and the Service is provided "as is." We don't guarantee it will meet your needs or be uninterrupted, error-free, or secure, and we make no warranty about the accuracy or reliability of any content on it (including community-judged approvals). To the fullest extent the law allows, we disclaim all implied warranties, including fitness for a particular purpose and merchantability.

Data loss. We are not responsible for the security of your account or your content. Any damage that occurs to you, your device, or your data as a result of your use of the Service — including loss of your data — is your sole responsibility, and we are not liable for any such damage or loss.

13. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any damages arising from your use of the Service. Our total liability for any claim related to the Service is limited to the greater of one hundred Canadian dollars (CAD $100) or the amount you (or your family) paid us in the six months before the claim arose. This limit applies to all claims of any kind, including lost data, lost profits or revenues, consequential or punitive damages, negligence, strict liability, fraud, or torts of any kind.

Nothing in this section limits liability that cannot be limited under applicable law (for example, liability for gross negligence, willful misconduct, or matters affecting consumer-protection rights that can't be waived).

14. Indemnification

You agree to defend and hold Speed U and its affiliates harmless against any and all legal claims and demands, including reasonable attorney's fees, arising from your use or misuse of the Service, your breach of these Terms, your User Content, or your conduct or actions, except to the extent caused by our own violation of law or these Terms. We will select our own legal counsel and may participate in our own defense if we wish to do so.

15. Reverse Engineering and Security

You may not attempt to reverse-engineer, decompile, or disassemble the Service, or attempt to bypass or interfere with its security, including unauthorized access to any account, data mining, or interference with any user, host, or network connected to the Service.

16. Service Interruptions

We may need to interrupt access to the Service for maintenance or emergency work, scheduled or not. We are not liable for any loss caused by such downtime.

17. Dispute Resolution and Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Before pursuing a formal claim, both you and Speed U agree to try to resolve any dispute informally first by contacting each other directly.

18. Changes and Severability

If any part of these Terms is found unenforceable or invalid by a court of law, the rest remains in effect, and the prior effective version of that part will be considered enforceable and valid to the fullest extent. Our failure to enforce a provision on one occasion doesn't waive our right to enforce it later. These Terms, together with the Privacy Policy, are the entire agreement between you and Speed U regarding the Service.
